Sodomy II - Court of Appeal Dismisses Striking Out Application

The Court of Appeal in an unanimous decision dismissed Anwar's striking out application.

The court found that Anwar had not shown that the prosecution is oppresive and an abuse of process of court.

It also held that the medical reports showing no penetration are inconclusive and cannot be used to strike out the case.

Anwar's team's application for a stay of proceeding to appeal to Federal Court were also denied.

Karpal Singh, Anwar's lead counsel, will apply for appeal to Federal Court and to apply to stay the trial proceeding, which is to continue tomorrow.

Anwar when asked for opinion merely said when the case involved Najib and Rosmah (Prime Minister and his wife), it is very hard for the judges to be courageous, or so reported TheMalaysianInsider.
